Privacy Policy under article 13 of Legislative Decree no. 196 of 30/06/2003

Under the provisions of article 13 of legislative decree no. 196/2003, the user is hereby informed that Priano Marchelli S.p.A. (“PM”) will make use of personal data this is supplied by the user during the registration procedure, that is to say within the context of relations that will be established from time to time between the user of the website indicated hereunder and PM, in conformance with current applicable law and what is described hereafter:

1. PURPOSE.

Data shall be used for the following purposes:
a) formalities required for the registration of the user to the website https://prianomarchelli.it ;
b) formalities required by law, including any disposition of court authorities;
c) recording of historical data, as well as the processing of market and statistical analysis;
d) transmission of communications or other material relative to services and current news pertaining to PM or to other companies belonging to its Group, as well as concerning their commercial, promotional, advertising initiatives, including those found on the website www.prianomarchelli.it

2. METHOD.

Use may consist of the collection, processing, registration, communication and storage of the user’s personal data and will be performer both manually and by automatic and/or digital instruments.

3. COMMUNICATION AND DISCLOSURE.

Personal data may be communicated by PM to the categories of subjects mentioned below as an example, for the purposes indicated above: (i) other companies of the PM; (ii) third party subjects hired to perform or process data relative to the service provided, either wholly or in part, with which PM has stipulated commercial agreements. The data will not be disclosed.

4. TRANSFER ABROAD.

The user’s data may be transferred abroad to other companies within the PM in conformance with articles 43 and 44 of Legislative Decree no. 196/2003.

5. NATURE OF SUPPLY OF DATA.

The supply of the user’s data is optional. Any refusal to supply the data indicated above or to allow its treatment for the purposes indicated under point 1, letter a) shall render it impossible for PM to satisfy the request of registration and the consequent impossibility of performing the requested related services. On the other hand, any refusal to grant consent for the treatment of data for the purposes listed above under point 1, letters c) or d) shall not prejudice the registration procedure, but simply indicates the impossibility of PM to use the data for those purposes.

6. RIGHTS OF THE INTERESTED PARTY.

As an interested party, the user enjoys those rights under article 7, Legislative Decree no. 196/2003, among which the right to obtain from the owner confirmation of the existence of his/her own personal data and their availability in intelligible form, of the identifying data of the owner and the subjects whose data may be communicated, as well as to obtain the update, rectification and addition of data, its cancellation, transformation into anonymous form or the blocking of data treated in violation of the law as well as to oppose, for legitimate reasons, the treatment of data. For further information relative to the treatment and communication of personal data or to exercise rights under article 7 of Legislative Decree no. 196/2003, the user may contact PM by email, writing to info@prianomarchelli.it .

The owner of the data treatment is Priano Marchelli S.p.A., with registered office in Genoa, Via Degli Artigiani 58/A, 16162. The updated list of managers for data treatment, available for the treatment of data from time to time is available at the management office and may be obtained upon request to the mail contact cited above.

Permission is granted to the user to make use of the above mentioned intellectual property only for personal and informational purposes.
It is forbidden to copy, download, distribute, modify, produce derivative works or extracts, publish or otherwise use of exploit this material without the prior consent of PM or, depending on the case, of other owners of the relative copyrights, or unless such activity is not expressly permitted by notice or instructions on the website.

3. TRADEMARKS

The PM trademarks, logos, commercial names, symbols, icons and any other distinguishing marks contained in the pages of the website are registered trademarks and/or service trademarks of PM used in various countries around the world or in the process of being registered, or are granted for use to PM through licensing by the respective owners, depending upon the case.
Any reproduction or use in any form and for any purpose of the logos, commercial names, symbols, icons and any other distinguishing marks is therefore forbidden.
PM reserves the right to take any and all legal action necessary to protect its rights.

4. COOKIES

Except for those cases envisioned in article 122 of Italian legislative decree no. 196 of 2003, PM may use cookies to collect information concerning users who access the website to personalise their access while saving a memory of their configurations. PM may at the same time use cookies by third parties for the sole purpose of monitoring traffic on the website (Google Analytics). These cookies are program files that the user’s browser registers on his/her computer while navigating on the website. The majority of browsers accept these cookies automatically.
The automatic registration may be avoided or cancelled later, by configuring the browser not to accept the cookies or by signalling when a cookie is sent. During this process, PM gathers only anonymous data, that does not there constitute personal data and which, in any case, is not communicated to third parties nor used to get in contact with the user.

5. ELECTRONIC MAIL MESSAGES

Electronic mail messages (e-mail) that may be sent by the user to the contact addresses indicated on the website are not published or otherwise disclosed (unless expressly authorised by the sender) and are saved in a special directory of PM’s digital system for a period of time strictly necessary for the purposes for which those messages are sent.
Access to those messages is granted to authorised persons through an authentication system in conformance with attachment B of Italian legislative decree no. 196 of 2003.

6. LINKS TO OTHER WEBSITES

The website may contain links to third party websites, in respect of respecting the principles of decorum, honesty and integrity and, in any case within the limits permitted by law.
The links present on the website conform to the type of users of the website and, in any case, do not refer to material reserved for adults only or otherwise restricted or forbidden by law. The treatment of personal data recorded on the websites of third parties is performed by subjects that are independent of PM which declines all liability. In particular, PM is not liable for any violations imputed by their content.
Links to other sites on the first page of the website are permitted (surface links); no authorisation is necessary in that sense, but indication of the link inserted is appreciated. Any further link forms (in particular to text or extracts specifically inserted in the website, the so-called deep links) are subject to PM’s pre-evaluation.
